Submission Terms You may submit to us on a non-confidential basis any games or proposals that are owned and created by you for evaluation by PlayActive and/or LavaMind. You represent and warrent that you own all rights to the materials that you are submitting and that nothing in the material infringes upon or violates any third-party rights. You acknowledge that we also receive materials submitted by other third parties and that we develop games internally. Any material that you submit to us may be similar to other games that we currently have in our possession or that we may develop or receive at a later date, and you agree that you will not assert any claim against PlayActive and/or LavaMind or our customers in connection with any such similarities. PlayActive and/or LavaMind is under no obligation to evaluate or use any materials you submit to us. If there is any dispute arising out of a submission and if we so elect, you agree to submit any such dispute to arbitration in San Francisco, California. The arbitrator shall be a person experienced in the field in which any such dispute is made and shall be mutually selected by us. If we cannot agree on an arbitrator, an arbitrator shall be selected by the rules of the American Arbitration Association. The arbitration shall be controlled by the terms of this agreement. If you agree to the above terms, please send us an email with "I AGREE TO YOUR SUBMISSION TERMS" in the body of the email and a link to the material that you wish us to evaluate. If you do not agree, please do not send us anything. Please email text only (no attachments). If you are under the age of 13, please do NOT send us any email without your parent's written consent.
